Common questions about divorce and family law
At least six months. California does not finalize a divorce until six months after the other spouse is served or appears, and a contested case can take longer.
One spouse must have lived in California for six months and in the county for three months before filing for divorce. A legal separation has no residency wait.
30 calendar days from the day you are served, to file a Response (form FL-120) with the court and have a copy served on your spouse. If no Response is filed in time, the court can make orders about your marriage, your property and your children without hearing from you. What to do in the first 30 days
You file a request with the court. A judge rules on a temporary order the same day the request is filed, or the next court day if it comes in late, and the other person does not have to be notified first. A hearing on a longer order is then set within 21 days, or 25 with good cause. There is no court filing fee for the request. Restraining orders
